{"id":427,"date":"2020-11-10T12:14:00","date_gmt":"2020-11-10T12:14:00","guid":{"rendered":"https:\/\/www.fovyv.fr\/?p=427"},"modified":"2022-07-29T12:16:04","modified_gmt":"2022-07-29T12:16:04","slug":"la-negociation-sur-laccord-de-temps-de-travail-de-vyv3-services-et-biens-medicaux-touche-a-sa-fin","status":"publish","type":"post","link":"https:\/\/www.fovyv.fr\/?p=427","title":{"rendered":"La n\u00e9gociation sur l&rsquo;accord de temps de travail de VYV3 Services et Biens M\u00e9dicaux\u00a0touche \u00e0 sa fin.\u00a0"},"content":{"rendered":"\n<p>Apr\u00e8s plus d\u2019un an et demi de n\u00e9gociation, le projet d\u00e9finitif d\u2019accord sur le temps de travail sera mis \u00e0 la signature des organisations syndicales le vendredi 13 novembre.<\/p>\n\n\n\n<p>Lors de cette n\u00e9gociation, le syndicat FO revendiquait principalement&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La mise en place de la semaine de 4 jours appliqu\u00e9e dans la Sarthe \u00e0 l\u2019ensemble du personnel du groupe VYV3 Services et Biens M\u00e9dicaux des Pays de la Loire.<\/li><li>Une annualisation \u00e0 1555h<\/li><li>Le pointage pour l\u2019ensemble des salari\u00e9s du groupe.<\/li><li>Que le forfait jour soit limit\u00e9 aux seuls cadres dirigeants.<\/li><li>Que l\u2019accord ne soit pas dans le cadre d\u2019un accord de performance collective.<\/li><\/ul>\n\n\n\n<p>Il \u00e9tait \u00e9vident d\u00e8s les premi\u00e8res r\u00e9unions de n\u00e9gociation que la direction refuserait d\u2019inscrire la semaine de 4 jours dans l\u2019accord. La direction a expliqu\u00e9 aux organisations syndicales que cet accord permettrait n\u00e9anmoins de conserver les organisations de travail actuelles si celles-ci permettaient de garantir un service optimal aupr\u00e8s de la client\u00e8le.<\/p>\n\n\n\n<p>Compte tenu de ce blocage, pour syndicat FO, il \u00e9tait alors primordial que cet accord comporte un nombre de jours de repos minimum garantis.<\/p>\n\n\n\n<p>Fo n\u2019acceptait pas une situation ou la direction aurait toute latitude modifier l\u2019organisation et faire travailler les salari\u00e9s 5 jours par semaine, sans jours de repos.<\/p>\n\n\n\n<p>Le syndicat FO revendiquait 23 jours garantis de repos dans l\u2019ann\u00e9e. Apr\u00e8s d\u2019\u00e2pres discussions, la direction garantie finalement 12 jours de repos et 34 jours ouvrables de Cong\u00e9s Pay\u00e9s. Cela est une avanc\u00e9e importante pour un certain nombre de d\u00e9partements qui ne b\u00e9n\u00e9ficiait pas de cette garantie, ainsi que pour certaines cat\u00e9gories de personnel. Ainsi, les assistantes audio r\u00e9cemment embauch\u00e9es dans le groupe avaient une organisation du travail qui les privaient de jours de repos. Cet accord, s\u2019il est sign\u00e9 pourrait leur permettre d\u2019en avoir 12.&nbsp;<\/p>\n\n\n\n<p>Concernant le pointage, les syndicat FO a obtenu qu\u2019il soit appliqu\u00e9 pour l\u2019ensemble des salari\u00e9s n\u2019ayant pas de fonction de management. L\u00e0 encore, ce point a \u00e9t\u00e9 l\u2019objet de vives discussions. Pour la direction, le pointage ne devait concerner au d\u00e9part que les cat\u00e9gories de personnel E et T. Cela posait probl\u00e8me puisque dans le 49, le 53 et une partie des salari\u00e9s du 85, les opticiens sont en cat\u00e9gorie C. Il y avait donc 2 poids 2 mesures entre des personnes qui ont exactement les m\u00eames fonctions dans l\u2019entreprise. La direction a finalement c\u00e9d\u00e9 sur ce point. Pour autant, malgr\u00e9 son argumentaire, le syndicat FO n\u2019a pas r\u00e9ussi \u00e0 obtenir le pointage pour les directeurs et responsables d\u2019\u00e9tablissement. FO souhaitait un pointage pour toutes les cat\u00e9gories, seule garantie contre \u00ab&nbsp;un travail sans fin&nbsp;\u00bb et des heures suppl\u00e9mentaires non pay\u00e9es.<\/p>\n\n\n\n<p>Le syndicat FO revendiquait le maintien des 48h de repos cons\u00e9cutifs inscrites dans la Convention Collective Nationale ANEM. Sur ce point, la direction est rest\u00e9e clairement oppos\u00e9e \u00e0 cette revendication. Elle propose que dans les magasins ouverts 6 jours sur 7, les salari\u00e9s b\u00e9n\u00e9ficient d\u2019au moins deux fois 48 heures cons\u00e9cutive de repos comprenant le dimanche dans le mois dont une fois comprenant un samedi (hors samedi pris en cong\u00e9 pay\u00e9).<\/p>\n\n\n\n<p>Lors de l\u2019avanc\u00e9e des n\u00e9gociations, la direction a tent\u00e9 de faire passer cet accord de temps de travail dans le cadre d\u2019un accord de performance collective. Cela aurait pu permettre \u00e0 la direction de modifier certaines modalit\u00e9s inscrites dans les contrats de travail sans contrepartie. C\u2019\u00e9tait sans compter sur la vigilance d\u2019une repr\u00e9sentante FO pr\u00e9sente lors des n\u00e9gociations qui s\u2019est rendu compte des cons\u00e9quences que cela aurait pu avoir. La direction a finalement fait marche arri\u00e8re et retir\u00e9 cet article inacceptable.<\/p>\n\n\n\n<p>Un article sur les frais de d\u00e9placements pose actuellement probl\u00e8me et est encore en discussion. En effet, cet article pourrait priver un certain nombre de salari\u00e9s de frais de d\u00e9placements (notamment dans le secteur audio. La direction \u00e9tudie actuellement la question soulev\u00e9e par le syndicat FO et &nbsp;doit revenir vers nous le jeudi 12 novembre.<\/p>\n\n\n\n<p>En tout \u00e9tat de cause, si la n\u00e9gociation a permis un certain nombre d\u2019avanc\u00e9es nous savons que selon les d\u00e9partements certaines dispositions sont moins avantageuses que ce qui existait auparavant.
