{"id":840,"date":"2019-09-18T10:25:00","date_gmt":"2019-09-18T10:25:00","guid":{"rendered":"https:\/\/www.fovyv.fr\/?p=840"},"modified":"2022-08-02T12:01:44","modified_gmt":"2022-08-02T12:01:44","slug":"prise-ne-charge-des-jours-de-carence-par-lemployeur-fo-ne-lachera-pas-la-proie-pour-lombre","status":"publish","type":"post","link":"https:\/\/www.fovyv.fr\/?p=840","title":{"rendered":"Prise ne charge des jours de carence par l&#8217;employeur: FO ne l\u00e2chera pas la proie pour l&rsquo;ombre!"},"content":{"rendered":"\n<p>Une R\u00e9union Syndicats\/Direction intitul\u00e9e <em>\u00ab dialogue social<\/em> \u00bb a eu lieu jeudi 23 avril 2020 en visioconf\u00e9rence.<\/p>\n\n\n\n<p>La discussion a port\u00e9 essentiellement sur la question de la prise en charge par l\u2019employeur du d\u00e9lai de carence pour maladie.<\/p>\n\n\n\n<p><strong>Qui est \u00e0 l\u2019origine de cette demande d\u2019ouverture de n\u00e9gociations ?<\/strong><\/p>\n\n\n\n<p>D\u00e9but juin 2019, une gr\u00e8ve massive reconductible a eu lieu dans les EHPAD du MAINE-ET-LOIRE.<\/p>\n\n\n\n<p>Apr\u00e8s quatre jours de gr\u00e8ve, un compromis est intervenu entre les organisations syndicales FO, CGT et la Direction.<\/p>\n\n\n\n<p>Celui-ci pr\u00e9voyait notamment l\u2019engagement du Directeur G\u00e9n\u00e9ral \u00e0 ouvrir des n\u00e9gociations sur la prise en charge du d\u00e9lai de carence.<\/p>\n\n\n\n<p>Lors de la r\u00e9union du jeudi 23 avril, la Direction fait une proposition en deux temps :<\/p>\n\n\n\n<p>1\/ Prise en charge par l\u2019entreprise de 2 jours de carence une fois par an sur une p\u00e9riode allant de 18 \u00e0 24 mois (p\u00e9riode d\u2019essai).<\/p>\n\n\n\n<p>2\/ la prise en charge du troisi\u00e8me jour de carence une fois par an, serait conditionn\u00e9e \u00e0 l\u2019abandon par les organisations syndicales signataires de l\u2019accord de 2013 portant sur la r\u00e9cup\u00e9ration pour tous des jours f\u00e9ri\u00e9s co\u00efncidant avec un jour de repos.<\/p>\n\n\n\n<p><strong>Soyons pr\u00e9cis&nbsp;:<\/strong><\/p>\n\n\n\n<p>En 2011, la f\u00e9d\u00e9ration patronale FEHAP d\u00e9nonce partiellement la convention collective CCN 51. Une des cons\u00e9quences majeures est la perte de la r\u00e9cup\u00e9ration des jours f\u00e9ri\u00e9s co\u00efncidant avec un jour de repos pour tous les salari\u00e9s embauch\u00e9s apr\u00e8s le 2 d\u00e9cembre 2011.<\/p>\n\n\n\n<p>Ceux embauch\u00e9s avant cette date conservent ce droit au titre des avantages individuels acquis.<\/p>\n\n\n\n<p><strong>FO et la CGT ont imm\u00e9diatement d\u00e9nonc\u00e9 la mise en place d\u2019un double statut et ont appel\u00e9 \u00e0 la gr\u00e8ve.<\/strong><\/p>\n\n\n\n<p>Dans nombre d\u2019\u00e9tablissements et fondations appliquant la CCN 51, des accords sont sign\u00e9s pr\u00e9voyant le maintien de la r\u00e9cup\u00e9ration des jours f\u00e9ri\u00e9s co\u00efncidant avec un jour de repos. Ce fut le cas au niveau de la Mutualit\u00e9 Fran\u00e7aise Anjou Mayenne.<\/p>\n\n\n\n<p>Lors du regroupement r\u00e9gional ayant constitu\u00e9 l\u2019UMPAPDL, le syndicat FO s\u2019est clairement prononc\u00e9 pour l\u2019extension \u00e0 tous les salari\u00e9s de cet accord.<\/p>\n\n\n\n<p><strong>En effet, notre organisation syndicale se prononce pour l\u2019\u00e9galit\u00e9 entre salari\u00e9s sur la base la plus favorable.<\/strong><\/p>\n\n\n\n<p><strong>Soyons clair&nbsp;:&nbsp;<\/strong><\/p>\n\n\n\n<p>Si la Direction allait jusqu\u2019au bout de son projet, nous assisterions \u00e0 l\u2019extension d\u2019un double statut. L\u2019ensemble des nouveaux embauch\u00e9s salari\u00e9s serait donc d\u00e9favoris\u00e9 y compris ceux ayant b\u00e9n\u00e9fici\u00e9 de l\u2019accord jusqu\u2019\u00e0 pr\u00e9sent.<\/p>\n\n\n\n<p><strong>Qui pourrait accepter une telle injustice&nbsp;?<\/strong><\/p>\n\n\n\n<p>Alors que tous les jours, les salari\u00e9s des EHPAD sont confront\u00e9s \u00e0 une situation catastrophique avec des milliers de d\u00e9c\u00e8s de r\u00e9sidents au niveau national, en lien avec l\u2019incurie gouvernementale.<\/p>\n\n\n\n<p>Au moment o\u00f9, M Francis GUITEAU, Directeur G\u00e9n\u00e9ral R\u00e9gional du groupe VYV 3 adresse un message de remerciements \u00e0 l\u2019ensemble des salari\u00e9s en date du 20 avril dans lequel il \u00e9crit notamment&nbsp;: &nbsp;\u00ab&nbsp;<em>Les EHPAD, ou les maisons d&rsquo;accueil sp\u00e9cialis\u00e9es, mais aussi pour ce qui concerne notre r\u00e9gion le SSR Saint-Claude, constituent naturellement les \u00e9tablissements au c\u0153ur des attentions, des risques, et des complexit\u00e9s de gestion associ\u00e9es, parce qu&rsquo;ils cumulent l&rsquo;\u00e2ge des r\u00e9sidents, les polypathologies, et le mode de vie en collectivit\u00e9 qui est tr\u00e8s d\u00e9favorable dans de telles circonstances, mais je veux dire que l&rsquo;anticipation et la rigueur de l&rsquo;application de m\u00e9thodes vertueuses ont sans doute permis d&rsquo;\u00e9pargner un certain nombre de r\u00e9sidents, et nous pouvons nous en f\u00e9liciter, et en f\u00e9liciter les auteurs.&nbsp;\u00bb<\/em><\/p>\n\n\n\n<p><strong>Qui pourrait accepter que le personnel se voit spoli\u00e9 de plusieurs jours de r\u00e9cup\u00e9ration de jours f\u00e9ri\u00e9s par an<\/strong><strong>&nbsp;?<\/strong><\/p>\n\n\n\n<p>Chacun l\u2019aura compris, la proposition de la direction visant \u00e0 l\u2019abandon de la prise en charge d\u2019un troisi\u00e8me jour de carence contre l\u2019abandon de l\u2019accord sur les jours f\u00e9ri\u00e9s pour tous est un march\u00e9 de dupes.<\/p>\n\n\n\n<p>On peut s\u2019interroger : comment ne pas \u00e9tablir un lien entre la volont\u00e9 de la Direction de remettre en cause les acquis et l\u2019ordonnance gouvernementale 2020-323 du 25 mars dernier qui, au pr\u00e9texte d\u2019\u00e9tat d\u2019urgence sanitaire, permet aux employeurs d\u2019allonger la dur\u00e9e du travail, de s\u2019attaquer aux jours de repos ou RTT, au compte \u00e9pargne temps et aux cong\u00e9s annuels\u2026.<\/p>\n\n\n\n<p><strong>Oui FORCE OUVRI\u00c8RE est pour la n\u00e9gociation,<\/strong><\/p>\n\n\n\n<p><strong>Oui FORCE OUVRI\u00c8RE est pour aboutir \u00e0 des compromis lorsqu\u2019ils am\u00e9liorent, m\u00eame de fa\u00e7on partielle, la situation des salari\u00e9s,<\/strong><\/p>\n\n\n\n<p><strong>FO est pr\u00eat \u00e0 \u00eatre signataire<\/strong><strong> d\u2019un accord qui mettrait en place&nbsp;la prise en charge de deux jours du d\u00e9lai de carence une fois par an. De notre point de vue, il s\u2019agirait d\u2019une avance, dans l\u2019attente de la poursuite de la n\u00e9gociation.<\/strong><\/p>\n\n\n\n<p><strong>FO ne saurait accepter<\/strong><strong> de participer \u00e0 la remise en cause de l\u2019accord sur la r\u00e9cup\u00e9ration des jours f\u00e9ri\u00e9s co\u00efncidant avec un jour de repos pour tous,<\/strong><\/p>\n\n\n\n<p><strong>FO maintient sa revendication d\u2019extension \u00e0 tous les salari\u00e9s de l\u2019UMPAPDL de l\u2019accord de 2013 sur la r\u00e9cup\u00e9ration des jours f\u00e9ri\u00e9s co\u00efncidant avec un jour de repos pour tous.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>Une R\u00e9union Syndicats\/Direction intitul\u00e9e \u00ab dialogue social \u00bb a eu lieu jeudi 23 avril 2020 en visioconf\u00e9rence.
