La Direction nous a pr\u00e9sent\u00e9 son projet au cours de la s\u00e9ance sans possibilit\u00e9 pour les d\u00e9l\u00e9gations syndicales d\u2019en prendre connaissance avant.<\/p>\n\n\n\n<p><br>N\u00e9anmoins, Force Ouvri\u00e8re a r\u00e9agi avec vigueur sur le fond du projet pr\u00e9sent\u00e9.<\/p>\n\n\n\n<p><br>Pour commencer, la d\u00e9l\u00e9gation FO a relev\u00e9 <strong>la contradiction suivante :<\/strong><br>Dans <strong>l\u2019art. 2<\/strong> du projet d\u2019accord, le t\u00e9l\u00e9travail est d\u00e9fini comme une \u00ab <strong>forme d&rsquo;organisation du travail dans laquelle un travail qui aurait \u00e9galement pu \u00eatre ex\u00e9cut\u00e9 dans les locaux de l\u2019entreprise est effectu\u00e9 par un salari\u00e9 hors de ces locaux de fa\u00e7on volontaire \u00bb.<\/strong><\/p>\n\n\n\n<p><br>POUR FO, LE TELETRAVAIL DOIT RESTER LIBREMENT CHOISI PAR LE SALARIE<\/p>\n\n\n\n<p><br>Or si tel est le cas, pourquoi avoir fait r\u00e9f\u00e9rence \u00e0 l\u2019art L.1222-11* dans <strong>l\u2019art.7.3<\/strong> qui permet \u00e0 l\u2019employeur d\u2019imposer le t\u00e9l\u00e9travail. En effet, un changement des conditions de travail d\u00e9cid\u00e9 par l\u2019employeur n\u2019exige pas d\u2019avenant \u00e0 contrat de travail. Et le salari\u00e9 ne peut pas refuser une modification de ses conditions de travail sous peine d\u2019\u00eatre sanctionn\u00e9 pour faute professionnelle<\/p>\n\n\n\n<p><br>POUR FO, LE FINANCEMENT DES OBLIGATIONS DU SALARIE EN TELETRAVAIL DOIT ETRE ASSURE PAR L\u2019EMPLOYEUR<\/p>\n\n\n\n<p><br>En cas de crise sanitaire comme nous la connaissons aujourd\u2019hui, toutes les dispositions de <strong>l\u2019art.5.2<\/strong> (<em>contrat multirisques habitation couvrant les risques li\u00e9s \u00e0 l\u2019exercice de l\u2019activit\u00e9 en t\u00e9l\u00e9travail, ligne haut d\u00e9bit, espace permettant de garantir \u00ab un bon niveau de concentration \u00bb, une parfaite confidentialit\u00e9, mise en conformit\u00e9 avec les normes \u00e9lectriques<\/em>) <strong>s\u2019appliquent et cr\u00e9ent une obligation imputable au salari\u00e9.<\/strong><\/p>\n\n\n\n<p><br><strong>Force Ouvri\u00e8re demande d\u2019ores et d\u00e9j\u00e0 que soit inscrit dans l\u2019accord, l\u2019obligation pour l\u2019employeur d\u2019assurer le financement des dispositions de cet art.5.2.<\/strong><\/p>\n\n\n\n<p><br>POUR FO, EN CAS DE REVERSIBILITE, LE RETOUR DU SALARIE DOIT SE FAIRE SUR LE SITE DE L\u2019ENTREPRISE<\/p>\n\n\n\n<p><br><strong>Art3 <\/strong>: Force Ouvri\u00e8re demande que la r\u00e9versibilit\u00e9 (arr\u00eat de l\u2019exercice de l\u2019activit\u00e9 en t\u00e9l\u00e9travail) \u00e0 l\u2019initiative du salari\u00e9 ou de l\u2019employeur, se fasse par un retour du salari\u00e9 sur le site de l\u2019entreprise et qu\u2019en aucun cas l\u2019employeur ne puisse exiger du salari\u00e9 qu\u2019il exerce son activit\u00e9 sur le site d\u2019une des entit\u00e9s du groupe.<\/p>\n\n\n\n<p><br><strong>Art 5 <\/strong>: Force Ouvri\u00e8re demande que le lieu d\u2019exercice du t\u00e9l\u00e9travail soit \u00e0 la main du salari\u00e9 et ne soit en aucun cas impos\u00e9 par l\u2019employeur tout comme le nombre de jours et la fixation des jours t\u00e9l\u00e9travaill\u00e9s dans la semaine.<\/p>\n\n\n\n<p><br>FO RAPPELLE QUE L\u2019EMPLOYEUR A UNE OBLIGATION DE MOYENS EN MATIERE DE PROTECTION DE LA SANTE DES SALARIES<\/p>\n\n\n\n<p><br><strong>Art.9<\/strong>: Il stipule que \u00ab le salari\u00e9 doit notamment veiller \u00e0 respecter les dur\u00e9es maximales de travail et minimales de repos quotidiens et hebdomadaires \u00bb.<\/p>\n\n\n\n<p><br>En cr\u00e9ant une obligation pour le salari\u00e9, l\u2019employeur se d\u00e9douane de toute responsabilit\u00e9 dans l\u2019augmentation de la charge de travail d\u2019un t\u00e9l\u00e9travailleur.<br>Or l\u2019employeur a une obligation de moyens concernant la protection de la sant\u00e9 physique et mentale des salari\u00e9s sur site et des salari\u00e9s t\u00e9l\u00e9travailleurs.<\/p>\n\n\n\n<p><br><strong>FO demande que l\u2019accord fasse \u00e9tat des moyens que l\u2019employeur compte mettre en oeuvre pour prot\u00e9ger la sant\u00e9 des salari\u00e9s.<\/strong><\/p>\n\n\n\n<p><br>FO RAPPELLE QUE L\u2019EMPLOYEUR DOIT REMBOURSER LES FRAIS PROFESSIONNELS ET DEMANDE INDEMNISATION DES FRAIS DE REPAS<\/p>\n\n\n\n<p><br><strong>Art. 14 et Art. 15 <\/strong>: Force ouvri\u00e8re demande le remboursement des frais professionnels et l\u2019indemnisation des frais repas.<\/p>\n\n\n\n<p><strong>Art.16 et Art. 19 <\/strong>: FO demande le retrait de toute mention stipulant des sanctions disciplinaires \u00e0 l\u2019encontre des salari\u00e9s.<\/p>\n\n\n\n<p><strong>Nos demandes ne sont pas exhaustives et s\u2019affineront au fur et \u00e0 mesure de l\u2019avanc\u00e9e des n\u00e9gociations.
